Norfolk Southern Railway Company (“NS”) is the rail provider for GIP. Users may transport containers between GPA’s Mason Mega-Rail Terminal and GIP by utilizing train service provided by NS. The use of the train service provided by NS shall constitute a consent to the terms and conditions of the railroad’s Intermodal Rules Circular #2 (the “NS Intermodal Rules Circular) and shall evidence the User’s agreement to all applicable terms and conditions contained therein. In the event that the Authority incurs any charges for train services under the NS Intermodal Rules Circular related to a specific shipment, then, in addition to the charges payable by the User under this MTOS, the Authority shall pass through such additional charges to the User and the User agrees to pay the Authority for the additional amounts due under the NS Intermodal Rules Circular for the shipment.
